General Conditions

ORGANISATION
The trips on this website were organised by Vamos Fugir Lda.

By hiring Vamos Fugir? Travel and Expeditions, the client automatically agrees to the conditions we apply. Vamos Fugir? Viagens e Expedições, Taxpayer No. 510655360 and Portuguese Tourism Licence RNAVT No. 4155. It will always be up to the Agency to decide the place and city for resolving conflicts.

REGISTRATION
Payments are dealt with on a case-by-case basis. Payment conditions will be proposed for each trip. All our services require proper organisation and non-payment by the traveller entitles us to cancel and apply the appropriate charges for non-payment.

INFORMATION UNDER LAW NO. 144/2015 OF 8 SEPTEMBER
Under the terms of Law no. 144/2015 of 8 September in its current wording, we would like to inform you that the Traveller may resort to the following Alternative Dispute Resolution Entities: - Customer Ombudsman for Travel and Tourism Agencies at www.provedorapavt.com - Arbitration Commission of Turismo de Portugal at www.turismodeportugal.pt
 

COMPLAINTS
Any complaint must be made in writing within a maximum of 15 days of the journey and must be submitted to the services and suppliers with supporting documents.

In the event of a complete disagreement, the customer can go to the website of the Directorate General for Consumer Affairs at www.consumidor.pt and www.turismodeportugal.pt.

BAGGAGE
Although our insurance covers material losses, the agency is not responsible for travellers' luggage. In the event of damage, loss or theft, it is up to the traveller to complain to the service provider when their luggage is lost, damaged or destroyed.

DOCUMENTATION
The Traveller must have their personal or family documentation in good order (ID card, passport, military documentation, authorisation for minors, visas, vaccination certificates and any other documentation that may be required). The agency declines all responsibility for refusing to grant visas or not allowing the Traveller to enter a foreign country, and the Traveller will be responsible for any and all costs arising from this situation.

Covid-19 (Pandemic)

Any interference in the future that prevents us from travelling for all the reasons that a contagious disease can bring to the traveller. Vamos Fugir Lda has decided to include Covid cancellation assistance insurance for international trips. Failure to present the protocols required by any authority, tests, certificates, etc., will invalidate our ability to assist the traveller, whether they are going to or returning from any part of the world.

DATES

No traveller can change the date of their trip without prior notice from the Agency. This action is only possible with telephone and written discussions via sms, whatsapp and emails. Changes to dates, when possible through all the suppliers, the traveller must be aware of the expenses, charges and fees requested by the Agency.

ASSIGNMENT OF REGISTRATION (CONTRACTUAL POSITION)
The traveller can give up their position and be replaced by another person who fulfils all the conditions required for the package, provided they inform Vamos Fugir? Unipessoal Lda. in writing no later than seven consecutive days before the scheduled departure date. The transferor and the transferee are jointly and severally liable for the payment of the outstanding balance and any additional fees, charges or costs arising from the transfer, which will be duly informed and proven by the travel and tourism agency. 

CHANGES TO BE MADE BY THE AGENCY
Whenever, before the start of the organised trip,
(i) the travel and tourism agency is obliged to significantly alter any of the main characteristics of the travel services,
(ii) or is unable to meet the special requirements requested by the Traveller,
(iii) or proposes to increase the price of the package by more than 8%, the traveller may, within 8 (eight) days:
a) Accept the proposed amendment;
b) Terminate the contract, without any penalty, and be reimbursed the sums paid;
c) Accept a replacement package offered by the travel and tourism agency and be reimbursed in the event of a price difference.
Failure by the traveller to reply within the time limit set by the travel and tourism agency will imply tacit acceptance of the proposed change.
 

CANCELLATION OF THE CONTRACT BY THE AGENCY
When the trip is dependent on a minimum number of participants, the Agency reserves the right to cancel the trip if the number of participants reached is less than the minimum. In such cases, the traveller will be informed in writing of the cancellation within the period decided by the Agency itself.

Before the start of the package, the travel and tourism agency may also terminate the contract if it is prevented from carrying it out due to unavoidable and exceptional circumstances. Termination of the travel contract by the agency under the above terms only entitles the traveller to rescheduling or reimbursement.
 

PRICE CHANGE
The agency reserves the right to correct prices whenever necessary due to exchange rates, extra-community rules or increases in fuel prices. This situation is very common and we have decided to inform customers that since the Covid-19 pandemic our service policy is higher than the common contractual provision of tourist services. In the case of personalised programmes, this will not happen when we have already issued air tickets. This protects both the client and the agency.

REFUNDS
Once the trip has begun, no reimbursement is due for services not used by the Traveller for reasons of force majeure or for reasons attributable to the Traveller, unless reimbursed by the respective suppliers. Failure to provide the services provided for in the travel programme for reasons attributable to the organising agency and if it is not possible to replace them with equivalent ones, entitles the Traveller to be reimbursed for the difference between the price of the services provided for and those actually provided.
 

QUITS

a - The traveller can cancel their trip at any time before it starts, but if they withdraw from the trip up to 60 days before the start date of the travel programme, they will lose 30% of the value of the programme, which was given by the client to the Agency as a non-refundable deposit.

This element (a) will always be mentioned in the conditions of each journey.

If this cancellation occurs 60 days or less before the start date of the programme, the total value of the travel programme will be forfeited. You will also lose the value of any additional services you have requested.

b - Travellers can cancel their trip for various reasons that are covered by our travel insurance policy. Cancelling without good reason does not entitle you to a refund.


You will also not be entitled to a refund if you wish to withdraw because you do not have a certificate for any of the vaccinations required by the destination country, such as the COVID-19 vaccine.

Once the trip has begun, no refund will be due to the customer for not using services or not taking advantage of programmes due to force majeure or a cause attributable to the customer, even if it is negligent.

EUROPEAN HEALTH INSURANCE CARD

Customers (regardless of age) travelling within the European Union must have their civil identification document (passport, ID card, Citizen's Card);
To obtain medical assistance, they must have their European Health Insurance Card.

RESPONSIBILITY
The travel and tourism agency is responsible for the correct execution of all the travel services included in the travel contract. In the case of organised trips, travel and tourism agencies are liable to Travellers, even if the services are to be carried out by third parties and without prejudice to the right of recourse, under the applicable general terms.


Organising travel and tourism agencies are jointly and severally liable with retail agencies in the case of package travel. In the case of other travel services, the travel and tourism agency is liable for the correct issue of accommodation and transport tickets and also for the culpable choice of service providers if they were not suggested by the traveller.


The travel and tourism agency that acts as an intermediary in sales or bookings of single travel services is responsible for errors in issuing the respective tickets, even in cases resulting from technical deficiencies in the booking systems that are attributable to them.


The travel and tourism agency is responsible for any errors due to technical deficiencies in the booking system that are attributable to it and, if it has agreed to book a package or travel services that are part of related travel services, for errors made during the booking process. The travel and tourism agency is not responsible for errors in the booking that are attributable to the traveller or that are caused by unavoidable and exceptional circumstances. 

IMAGE
We take videos and photos on almost every trip. Vamos Fugir? Travel and Expeditions. uses images and videos as promotional material for our marketing. By accepting these general conditions, the traveller authorises the use of any content captured by our representatives in tourism advertising for the travel agency.

INSOLVENCY
In the event of insolvency of the travel and tourism agency, the traveller can use the Travel and Tourism Guarantee Fund, and should contact Turismo de Portugal I.P., the entity responsible for activating it: Turismo de Portugal, I.P. VAT
The prices mentioned in this programme reflect the provisions of DL 221/85 of 3 July, I. V. A. in the margin.
 

ARRIVAL AND DEPARTURE TIMES

In extreme cases of flight changes or road traffic that prevents the scheduled arrival at the times established for the services included in the travel package. The Travel Agency delegates any responsibility.

SPECIAL CONDITIONS FOR TRAVELLING
By making the booking, the customer guarantees that they are in full health to travel and that their health will not jeopardise the safety and comfort of the other passengers in the group. Passengers with special needs and reduced mobility are subject to the rules laid down in EU legislation on the transport of passengers with disabilities and reduced mobility. Considering that the vehicles used may not be prepared to accommodate wheelchairs and that some hotels may not have options suitable for people with special needs or reduced mobility, if necessary, those interested should contact the agency beforehand to find out from the suppliers whether these services are suitable for people with special needs or reduced mobility.
 

HOTELS/TRIPLE ROOMS
The price shown is per person and is based on double occupancy (double bed or twin beds). Not all hotels have a triple room and an extra bed is usually added, which may not be of the same quality as the others.
 

HOTELS
The list of hotels and flats included in the trips is indicative, as is their category, which respects the criteria and classifications attributed by the local authorities and which are sometimes different from those used in Portugal. They may be changed to similar ones when, for reasons beyond the agency's control, it is not possible to maintain or confirm the existing booking, and the agency is obliged to inform the client as soon as it becomes aware of this and the provisions of Decree-Law 17/2018 of 8th March apply to this type of situation.

Vamos Fugir? Viagens Lda values the comfort of its travellers. Only as a last resort and only in conditions of absolute surprise will we relocate our clients to a category lower than that mentioned in the travel programme.
 

MEALS
The meals indicated as included, whether in restaurants or hotels, will be served to the group at fixed times and with the same menu for all participants, not including drinks or special diets. However, all clients who require a different diet for different reasons (Vegetarian, Vegan, Coeliacs or any other factor or allergy... must inform the agency at the time of registration).
 

AIRPORT TAXES, SECURITY AND FUEL
By law, it is compulsory for the respective taxes to be included in the final price of the programme. However, we safeguard against any possible changes that may occur between the date this brochure was drawn up and the date the trip takes place, and the respective rates are therefore subject to legal changes up to 20 days before the trip.
 

VALIDITY
This document is valid until December 2023.
NOTE 
These general conditions may be supplemented by any other specific conditions as long as they are duly agreed by the parties. Programme preparation date: 10 January 2023
